About these terms

These terms cover mandarinmatch.com and the app at app.mandarinmatch.com, operated by Mandarin Match App, a sole proprietorship owned by Robert Muller, PO Box 603, Carlsbad, CA 92018 ("Mandarin Match", "we", "us"). By using them, you agree to these terms and our Privacy Policy (https://mandarinmatch.com/privacy). Contact: admin@mandarinmatchapp.com.

Who can use Mandarin Match

You must be at least 13 years old to use Mandarin Match. If you are 13 to 17, you may use it only with your parent or guardian's permission, and your parent or guardian agrees to these terms for you. Only an adult (18 or older) may buy a paid subscription, so a parent or guardian must buy any subscription for a user under 18. We will delete accounts and information we learn belong to anyone under 13. Mandarin Match is not directed to people in the European Union, European Economic Area or United Kingdom.

Accounts

Some features need an account. Keep your login details safe and make sure the information you add is accurate. You are responsible for activity on your account. The free tools on mandarinmatch.com, including Test My Chinese, can be used without an account.

Subscription, free trial and automatic renewal

The plan. There is one plan: a 10-day free trial, then $14.99 per month, tax included. There is no other plan.
Automatic renewal. Your free trial starts when you sign up. Unless you cancel before the trial ends, your subscription automatically renews and we will charge $14.99 to your payment method when the trial ends and every month after that until you cancel. We show these terms next to the sign-up button and ask for your agreement before starting your trial.
How to cancel. Cancel online at any time in your account at app.mandarinmatch.com: go to Account → Subscription (https://app.mandarinmatch.com/account/subscription) and select Cancel subscription. You can also email admin@mandarinmatchapp.com with the subject "Cancel". If we ever offer you a discount or other offer when you cancel, the cancel button stays visible the whole time.
Cancelling during the trial. If you cancel before the trial ends, you will not be charged.
Cancelling after the trial. Cancelling stops all future charges. Your access continues until the end of the month you have already paid for.
Confirmation and notices. After you sign up, we will email you a confirmation with these subscription terms, our cancellation policy and how to cancel. If we change the price, we will email you 7 to 30 days before the change takes effect, with instructions on how to cancel. We will also tell you about any other material change to your subscription terms. We may also send trial and renewal reminders by email.
Payments. Subscriptions bought on mandarinmatch.com or app.mandarinmatch.com are processed by Stripe, Inc. Card details are handled by Stripe and are not stored by us. Stripe's privacy policy: https://stripe.com/privacy.

Refunds

First-charge guarantee. If you are not satisfied, email admin@mandarinmatchapp.com within 7 days of your first paid charge and we will refund that charge in full. This is available once per customer.
Later charges. Later monthly charges are not refunded or prorated, except as stated below or where required by law. When you cancel, your access continues to the end of the paid month.
Always refunded. If you were charged after you cancelled, or charged in error, we will refund that charge.
App-store purchases. If you subscribed through the Apple App Store or Google Play, that store processes your payment, and its refund rules and process apply. Request refunds from the store.
Nothing in these terms limits any refund or other right you have under applicable law.

Store orders

Apparel and mug orders are sold through Shopify checkout and printed and shipped by Printful. Because items are printed on demand, we do not accept returns for change of mind or sizing. If an item arrives defective, damaged or wrong, email admin@mandarinmatchapp.com with a photo within 30 days of delivery and we will replace it or refund it at no cost to you. We ship within the time stated at checkout, or within 30 days if no time is stated, and we will tell you and offer a refund if we cannot.

Community and matching rules

Be respectful to other learners and teachers.
No harassment, threats or abuse.
No illegal content, and no sexual content involving or directed at minors.
Don't ask other users, especially minors, for personal contact details or to meet in person.

You can report a user or content by emailing admin@mandarinmatchapp.com, or with any in-app reporting or blocking tools we provide. We may remove content or suspend or close accounts that break these rules. If you choose to meet someone you matched with, meet in a public place and take normal safety precautions; we do not run background checks.

Your content

You keep ownership of content you post. You grant us a non-exclusive, royalty-free licence to host, store, display and transmit that content solely to operate and improve the service. This licence ends when you delete the content or your account, except for copies we must keep for safety or legal reasons.

If you subscribe, we will email you a weekly Mandarin tip and updates. Every email has an unsubscribe link, and you can unsubscribe anytime.

Disclaimer

We work hard to make Mandarin Match useful and accurate, but the service is provided "as is". We cannot promise it will always be available, error-free, or that you will reach a particular level.

Limitation of liability

To the extent the law allows, Mandarin Match is not responsible for indirect losses arising from your use of the service, and our total liability is limited to the amount you paid us in the 12 months before the claim. This does not limit liability that cannot be limited by law, including for gross negligence, fraud or willful misconduct.

Changes to these terms

We will give at least 30 days' notice of material changes by email and update the "Last updated" date. Changes to the subscription price or terms follow the Subscription section above.

Governing law and disputes

These terms are governed by the laws of the State of California, and any disputes will be handled in the courts of San Diego County, California, except that either of us may bring a claim in small claims court. Nothing in these terms limits rights you have under consumer protection laws that cannot be waived.
